Watchdog Halted Plan to Recover Secret Service Texts
The Department of Homeland Securitys chief watchdog scrapped its investigative teams effort to collect agency phones to try to recover deleted Secret Service texts this year, the [link=https://www.washingtonpost.com/national-security/2022/07/29/homeland-inspector-general-texts/?utm_source=alert&utm_medium=email&utm_campaign=wp_news_alert_revere&location=alert]Washington Post[/link] reports.

In early February, after learning that the Secret Services text messages had been erased as part of a migration to new devices, staff at Inspector General Joseph V. Cuffaris office planned to contact all DHS agencies offering to have data specialists help retrieve messages from their phones, according to two government whistleblowers who provided reports to Congress.

But later that month, Cuffaris office decided it would not collect or review any agency phones.

Probe widens into federal watchdog over missing Jan. 6 Secret Service texts
On Monday, investigators demanded records related to the deleted texts from the Office of Inspector General Joseph V. Cuffari, an appointee of President Donald Trump whose office shut down an inquiry into the Secret Service messages last year amid the Houses probe of the insurrection.

The records request, which was revealed in a federal [link=https://nclalegal.org/wp-content/uploads/2023/04/ECF-1-CIGIE-Complaint-and-Exhibits-ALL.pdf]lawsuit[/link] this week filed by Cuffari and his staff against the panel of inspectors leading the probe, suggests new urgency in a high-profile investigation that began in May 2021 and has since evolved into a wide-ranging inquiry into dozens of allegations of misconduct, including partisan decision-making, investigative failures and retaliation against whistleblowers.

The probe has paralyzed the inspector generals office, alienated Cuffari from the watchdog community and led to calls for President Biden to fire him. The president has signaled that he intends to stay out of the process until the panel from the Council of the Inspectors General on Integrity and Efficiency (CIGIE) completes its work. When a federal watchdog is accused of misconduct and the organization decides that it warrants attention, another inspector general is assigned to investigate, under a system set up by Congress.

As Congress convened on January 6, 2021, to certify the results of the 2020 presidential election in favor of Joseph R. Biden, Jr., thousands of supporters of the losing candidate, Donald J. Trump, converged on the United States Capitol to disrupt the proceedings. The Trump supporters swarmed the building, overwhelming law enforcement officers who attempted to stop them. The chaos wrought by the mob forced members of Congress to stop the certification and flee for safety. Congress was not able to resume its work for six hours. The question raised in this case is whether individuals who allegedly assaulted law enforcement officers while participating in the Capitol riot can be charged with corruptly obstructing, influencing, or impeding an official proceeding, in violation of 18 U.S.C. § 1512(c)(2). The district court held that the statute does not apply to assaultive conduct, committed in furtherance of an attempt to stop Congress from performing a constitutionally required duty. We disagree and reverse.

Judges Say Obstructing Electoral Vote Was a Crime
[link=https://electionlawblog.org/?p=135537]Rick Hasen[/link]: A divided three-judge panel of the D.C. Circuit, siding with almost all of the district court decisions considering the question, has held that some of those who invaded the U.S. Capitol on January 6, 2021 could be charged under a federal statute that makes it a crime to, among other things corruptly.obstructor impede any official proceeding, or attempts to do so.’
This case has implications not only for hundreds of January 6-related prosecutions, but also potentially against Donald Trump, should DOJ choose to charge him with election-subversion-related activities after the 2020 election.
Capitol Rioter Who Pinned Officer Sentenced to 7.5 Years
Few images captured the visceral violence and horror of Jan. 6 more clearly than the moment Patrick McCaughey a 23-year-old from Connecticut pinned a D.C. Police officer, Daniel Hodges, in a Capitol doorway as he howled in pain, [link=https://www.politico.com/news/2023/04/14/january-6-defendant-sentenced-00092117]Politico[/link] reports.

On Friday, more than two years later, McCaughey was sentenced to 7.5 years in prison for his role in the riot and attempt by supporters of Donald Trump to prevent the transfer of power to Joe Biden. His sentence is among the lengthiest handed down to Jan. 6 rioters so far, though it was less than half of the nearly 16 years that the Justice Department sought.

McCaughey pinned Hodges in a Capitol doorway for more than two minutes while another rioter ripped off the officers gas mask, stole his baton and struck him with it. It became a symbol of the barbaric violence that unfolded in the Capitols lower West Terrace tunnel, famous before that day as the corridor through which presidents-elect emerge to take their oath of office.

No “tourists” getting away with their actions that day. [image]https://www.flyertalk.com/forum/images/smilies/wink.gif[/image]

Authorities have arrested a New Mexico man accused of throwing a police officer on the ground during the U.S. Capitol riot more than two years ago. The U.S. Attorneys Office for the District of Columbia said in a news release Wednesday that 62-year-old Rockne Earles of Chama is facing felony and misdemeanor charges including assaulting, resisting, or impeding officers and civil disorder.

Video shows Earles on Jan. 6, 2021, grabbing and throwing a U.S. Capitol Police officer against stairs below scaffolding on the Capitol’s West Front with a significant amount of force, according to federal court documents. He and two others then shove and assault the officer.
Mom, son who took zip ties into Senate convicted in Jan. 6 riot
“U.S. District Judge Royce Lamberth convicted Eric Munchel and his mother, Lisa Eisenhart, on all 10 counts in their indictment, including a charge that they conspired to obstruct Congress from certifying President Biden’s 2020 electoral victory on Jan. 6, 2021. The judge is scheduled to sentence both of them Sept. 8.

Lamberth decided the case without a jury after a stipulated bench trial, an unusual legal proceeding in which defendants do not admit guilt to charges but agree with prosecutors that certain facts are true. At least three dozen Capitol riot defendants have resolved their cases that way which allows defendants to preserve their right to an appeal rather than opting for a traditional trial or pleading guilty.”

The settlement with Dominion is about 20 years worth of Tuckers salary. The SmartMatic suit is still pending, but I would guess it will end in a multi-million settlement in a few weeks which will push the damage north of a billion. Now Fox media makes about 5bil/year, but that’s gotta hurt in your investor disclosures.

If you run a trucking company and ‘Jim Bob’ jack-knifes the second rig in a year, the insurance company will tell you to get rid of ‘Jim Bob’ or they will drop you. Given Tuckers propensity to say stupid slandeorus sh!t on air that gets his employer sued, Fox’s reinsurer may have told them to axe him.

Former F.B.I. Agent Charged in Jan. 6 Riot Prosecutors say the former agent, who worked counterterrorism in the New York field office before leaving bureau in 2017, called police officers Nazis and illegally entered the Capitol.

From 2004 to 2017, Mr. Wise worked on counterterrorism matters at the F.B.I. in the New York field office. He was briefly detailed to Libya to help agents investigate the terrorist attack in Benghazi, Libya, in 2012, that killed four Americans. Mr. Wise left the bureau after his supervisors became unhappy with his work, and his career had stalled, a former senior F.B.I. official said.

Mr. Wise later joined the conservative group Project Veritas under the supervision of a former British spy, [link=https://www.nytimes.com/2020/10/21/us/politics/project-veritas-spy.html]Richard Seddon,[/link] who had been recruited by the security contractor Erik Prince to train operatives to infiltrate trade unions, Democratic congressional campaigns and other targets.

At Project Veritas, according to a former employee with direct knowledge of his employment, Mr. Wise used the code name Bendghazi and trained at the Prince family ranch in Wyoming with other recruits. Mr. Wise took part in an operation against a teachers union and apparently left Project Veritas in mid-2018, the former employee said.

Proud Boys Leader Found Guilty of Seditous Conspiracy
Former Proud Boys chairman Henry Enrique Tarrio and three other members of the extremist group were found guilty Thursday of seditious conspiracy in the Jan. 6, 2021, attack on the U.S. Capitol, the [link=https://www.washingtonpost.com/dc-md-va/2023/05/04/proud-boys-verdict-jan6-seditious-conspiracy/?utm_source=alert&utm_medium=email&utm_campaign=wp_news_alert_revere&location=alert]Washington Post[/link] reports.

Over nearly 15 weeks of trial, prosecutors alleged that the Proud Boys on trial saw themselves as Donald Trumps army.

Inspired by his directive to stand by during a September 2020 presidential debate and mobilized by his December 2020 call for a wild protest when Congress met to certify the election, prosecutors said the men sought to keep Trump in power through violence.

DOJ recommends 25 years for Stuart Rhodes, adds  terrorism enhancements to sentencing recommendation

[link=https://www.documentcloud.org/documents/23801119-rhodesetalsentmem050523]https://www.documentcloud…hodesetalsentmem050523[/link]

These defendants were prepared to fight. Not for their country, but against it.

In their own words, they were willing to die in a guerilla war to achieve their goal of halting the transfer of power after the 2020 Presidential Election. These defendants played a central and damning role in opposing by force the government of the United States, breaking the solemn oath many of them swore as members of the United States Armed Forces.

In seeking the stiff sentence for Rhodes on a rare seditious conspiracy conviction prosecutors said that lengthy sentences are necessary for the survival of American democracy.
As this Court is well aware, the justice systems reaction to January 6 bears the weighty responsibility of impacting whether January 6 becomes an outlier or a watershed moment, Assistant U.S. Attorney Jeffrey Nestler wrote in the [link=https://s3.documentcloud.org/documents/23801119/rhodesetalsentmem050523.pdf]183-page sentencing memo[/link]. Left unchecked, this impulse threatens our democracy.

Prosecutors arrived at those steep sentencing recommendations in part by labeling the actions of Rhodes and his co-conspirators terrorism, defined in the criminal code as acts that were intended to influence the government through intimidation or coercion. The Justice Department has sought this enhancement in relatively few Jan. 6 cases and with limited success.

Sentencing TODAY in high-profile Capitol riot case of Pauline Buaer of Pennsylvania

Prosecutors will seek more than 6 years prison time, emphasizing verbal threats against then-Speaker Nancy Pelosi

….

Judge Trevor McFadden begins Jan 6 defendant Pauline Bauers sentencing hearing by emphasizing his belief that Bauer gave demonstratively false information about her role on Jan 6 while testifying at trial

Defense: Bauer became interested in PA State Senator Doug Mastrianos politics during COVID and wanted country to open up.. and then had questions about the election

Defense acknowledges prior disrespect Bauer showed in earlier court hearings. He says, previously in case, Bauer said she was a sovereign citizen but adds she had people influencing her

Judge McFadden shows no expression as he listens to defense argue: The spirit of what she was trying to do was right. But everything that came out of her was wrong
