Stephen Breyer SCOTUS retirement and open seat?
Posted by btomba_77 on January 6, 2021 at 4:18 amWell. If the news holds and Dems control the Senate, it is probably time for Breyer to retire.
I hope he learns the RBG lesson of 2012. I might be another long stretch before Democrats control both the White House and the Senate.Strike while the iron is hot.
Supreme Court Justice Stephen Breyer to retire, giving Biden a chance to nominate a replacement
replacing him should be priority #1. Ram through a person who is young and not from Harvard, Yale or whatever holier than though college.
Waiting to hear the Mitch McConnel lines now. Well we don’t really appoint justices in off-year elections.-
Breyer Retirement Could Lead to Courts First Black Woman
There are two clear front-runners for the first opening in a new administration.{T}o legal insiders, Bidens options narrow down very quickly to two names: Justice Leondra Kruger of the California Supreme Court, and Judge Ketanji Brown Jackson of the federal district court in Washington, D.C.
Both are extremely accomplished, with gold-plated resumes that are reminiscent of the justices picked by President Barack Obama, and for that matter by President Donald Trump. Both are also super-smart and well-liked. And realistically, they are the only two Black women who are young enough to serve for the long haul and have the relevant judicial experience to make their confirmation straightforward, even boring which is just what a nominating president wants.

Brown Jackson was approved just 6 months ago for the DC court. Vote was 53-44

This will be interesting. Biden campaigned he would nominate black female. SCOTUS just agreed to hear the college admissions case which involves race. So if the court could rule students were discriminated against while the court itself is seating a new justice based on race and gender. This is the problem when candidates make such statements on their picks public.

1) Two issues (affirmative action vs political appointments) are very different and have no bearing on one another.
2) SCOTUS pick will be long settled before the court rules on affirmative action.-
As seen on twitters “Mitch McConnel pointing out that the Senate has never confirmed a Supreme Court Justice as Saturn transits through Aquarius”

Mitch McConnell “it is long standing tradition that we cannot confirm a Supreme Court Justice in a year where there’s a new season of Euphoria on HBO Max”
via daily show-
Unless some Democratic Senator dies an untimely death, Mitch doesn’t get much say.

Senate Democrats to Move Quickly to Replace Breyer
[link=https://www.politico.com/newsletters/huddle/2022/01/27/breyer-puts-cherry-on-top-of-senates-schedule-00002664?nname=huddle&nid=0000014f-1646-d88f-a1cf-5f46b4be0000&nrid=0000014e-f0ed-dd93-ad7f-f8edad790000&nlid=630309]Politico[/link]: Democrats are eyeing a timeline similar to what Republicans used to confirm Justice Amy Coney Barrett, which was about a month between her nomination and confirmation. The tight timeline doesnt reflect an overall rush.
Aides have said Democrats may consider confirming his replacement before this SCOTUS term is over, but delay the succession until after Breyer leaves his seat vacant.

Democrats dont need Republicans to hold a confirmation hearing in the Judiciary Committee, and they dont need them to vote in committee in order to advance a nomination. -

See Diane Feinstein. People like to talk about JB mental health. She doesn’t know what day it is and is there till 2025.
The Mitch jokes are great. the Onion “Mitch McConnell block Breyer from retiring” -
Some of the GQP commentary about nominating a black woman.yikes. Like is there no one there to say just shut up as you sound very racist.
-
Not really. What I did was tit for tat poking at the Chinese who decided to talk BS about the USA. The Chinese East dogs. Truth.
This is some GOP BS that now we need most qualified person for the job. Thats code for white guy from Yale.

Thanks for confirming what you think. As part of a mixed race family I found your comment borderline at best. I know you think its true so its not racist. Id like you to recognize how this idea is flawed.
I dont believe you are as racist as the Republicans making comments about a woman of color who may be a SCOTUS nominee. I do believe they are. I would have hoped you recognize how speech affects others and perhaps apologized. Oh well.

Murkowski , re:Biden nominating a Black woman to the Supreme Court: “I would be honored to be able to support an exceptional African-American woman.”

What is more racist than thinking certain races need gifts, over and over again? It’s tacit admission they are incompetent without being granted things … just because.

Michelle Childs Gets Boost from Sherrod Brown
After Sherrod Brown caught wind of the progressive angst over judge Michelle Childs possible ascension to the Supreme Court, the labor stalwart talked it through with her biggest Democratic backer the House majority whip, [link=https://www.politico.com/news/2022/02/09/left-splits-over-supreme-court-pick-00006979]Politico[/link] reports.
And the Ohio Democratic senator walked away satisfied from his conversation with Rep. Jim Clyburn (D-SC), whos stumping hard for his home-state judge to join the high court.
Said Brown: If shes chosen, Ill be enthusiastic. Ive heard things. I am reassured from Clyburn and others that she would be a good nominee.-
With only a few days left in February, court watchers are trying to read tea leaves as to the identity of President Joe Biden’s pick for the Supreme Court before his end-of-the-month deadline — and a federal court on Thursday increased the buzz around DC Circuit Judge Ketanji Brown Jackson.
The US Court of Appeals for the District of Columbia Circuit deviated from its typical procedure by issuing an opinion on a Thursday — breaking with its usual schedule of Tuesday and Friday release days. Notably, Jackson — who has interviewed with Biden for the Supreme Court nomination — was in the majority in the 2-1 ruling case.
Some legal experts took the release as a sign that Jackson could be the nominee and that the announcement could come as soon as Friday, especially because a similar scenario played out with now-Justice Brett Kavanaugh.
