  • HIPAA laws and family member chart images

    Can a family member give verbal permission to enter their chart and/or view their radiology studies?
     
    Edit: I’m actually pretty sure the answer to this question is no but I’m not sure how to delete the post.

      Have them send you an email to your official work mail address stating that they give you full and unrestricted permission to view their medical images and EMR. If anyone ever gives you trouble about it, the email should help.

        No, you cannot access the chart through the EMR like you would for a normal patient. While they have a right to access their medical records, it’s either through paper or a “patient portal.” Same applies to you: you cannot look at your own chart directly through the EMR.

          The original poster is actually asking two different questions:
           
          1) Can oral permission be sufficient to avoid you committing a HIPAA violation and/or can you provide yourself consent to look at you or your family member’s medical records?  Yes.
           
          2) Can doing so violate the institution’s own policies such that they can take disciplinary action against you?  Yes.
           
          In the end, it is not HIPAA that you need to worry about.
